Food Company Fined £360,000 After Worker Loses Fingers in Machine Accident
A significant safety failure has led to a heavy fine for Kerry Ingredients (UK) Limited after a serious incident at their Glasgow factory resulted in a worker losing four fingers.
Incident Overview
On 4 August 2021, a 39-year-old worker at the Kerry Ingredients factory in Hillington suffered a life-changing injury while attempting to clear a blockage in a mixer. The factory, which manufactures dry seasoning blends and mixes for the food industry, was operating normally until the mixer developed a blockage.
As the worker attempted to resolve the issue, he inserted his right hand into the machine. Tragically, his hand came into contact with the rotating blades, leading to the amputation of four fingers. The injury has forced him to relearn basic tasks using his left hand, affecting his life and work.
Investigation Findings
The Health and Safety Executive (HSE) conducted a thorough investigation into the incident and uncovered critical safety failings. Specifically, it was found that:
Lack of Fixed Guards:
There were no fixed guards in place to prevent access to the rotating blades from the underside of the machine.
Absence of Interlocked Guards:
The mixer was not equipped with interlocked guards that would automatically stop the machine’s rotating parts if any component on the underside was removed.
Legal Consequences
Kerry Ingredients (UK) Limited, based in Bristol, pleaded guilty to violating The Provision and Use of Work Equipment Regulations 1988, Regulations 11(1) and (2), as well as Section 33(1)(c) of the Health and Safety at Work etc. Act 1974.
On 8 August 2024, following a previous guilty plea on 26 July 2024, the company was fined £360,000.
HSE’s Stance
HSE principal inspector Hazel Dobb commented on the case, stating:
“This incident could so easily have been avoided by simply carrying out correct control measures and safe working practices. Companies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.”
